Strengthening Oversight of Broadcasting Regulations in Indonesia's Digital Landscape
Memperkuat Pengawasan Regulasi Penyiaran di Lanskap Digital Indonesia
Abstract
General Background: The rapid expansion of online platforms has led to significant challenges regarding compliance with moral and legal norms, necessitating effective supervision to uphold broadcasting quality and regulations. Specific Background: In Indonesia, the Indonesian Broadcasting Commission (KPI) plays a crucial role in ensuring that content on platforms like TikTok adheres to ethical and legal standards, yet faces limitations in its regulatory authority. Knowledge Gap: There is limited understanding of the current regulatory framework's effectiveness, particularly regarding the oversight of social media and live streaming, and how it affects content compliance. Aims: This research aims to analyze the regulatory challenges faced by the KPI and the need for policy revisions to enhance oversight mechanisms for online content. Results: Utilizing a normative juridical approach, the study focuses on relevant legislation, including Law No. 32 of 2002 on Broadcasting and Law No. 1 of 2024 on Electronic Information and Transactions, alongside secondary data from scholarly articles. Findings indicate that the lack of authority for KPI to oversee social media poses risks to compliance with broadcasting norms and highlights the necessity for revising existing laws to broaden KPI's jurisdiction. Novelty: This research contributes to the ongoing discourse on regulatory frameworks by advocating for an expansion of KPI’s oversight capabilities to include social media platforms. Implications: The study underscores the importance of collaboration between the government, online media platforms, and the public in fostering effective oversight and accountability, ultimately aiming to protect consumers from inappropriate content and create a safer online environment in Indonesia.
