Abstract

Abstract: This research investigates the rising phenomenon of online rotating savings and credit associations (arisan) in Indonesia, which have gained popularity yet remain susceptible to legal infractions such as embezzlement and fraud. Despite existing regulatory frameworks, a significant knowledge gap exists regarding the legal mechanisms necessary for protecting participants from these risks. Aims: This study employs the PRISMA method to systematically identify, screen, evaluate, and analyze Supreme Court decisions related to online arisan from 2018 to 2024, aiming to discern prevalent legal issues and suggest improvements. Results: Analysis reveals a total of 249 relevant cases, peaking in 2021, predominantly involving fraud, civil breaches (wanprestasi), and divorce linked to economic disputes. The study highlights that cases of fraud have increased significantly, particularly in urban areas like Surabaya, driven by attractive yet misleading offers of high returns. Legal provisions under the Indonesian Penal Code (KUHP) and the Civil Code (KUHPerdata) are invoked in addressing these issues, emphasizing the need for stringent regulation. Novelty: This research offers a comprehensive legal perspective on the dynamics of online arisan, revealing critical insights into the intertwining of economic motivations and legal protections. Implications: The findings underline the necessity for enhanced legal awareness and regulatory frameworks to mitigate risks associated with online arisan, advocating for government commitment and action to ensure the security and integrity of these financial practices. This study serves as a foundational reference for policymakers and legal scholars aiming to refine regulations surrounding online financial mechanisms in Indonesia.
